Terms of Use

These Terms of Use ("Terms") are a legal agreement between you and DAEM ("DAEM", "we", "us") governing your use of the DAEM mobile application (the "App") and the website at daem-app.com. By downloading, accessing, or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

1. The App, and a safety warning

DAEM is an entertainment app that measures how many times your phone rotates when you throw or spin it. Throwing your phone carries an obvious risk of damaging your device, your surroundings, and yourself or others. You use DAEM entirely at your own risk. You agree to:

Throw only in a safe, open area with a soft landing surface, away from people, pets, screens, windows, and breakables;
Never throw near roads, water, heights, or anyone who hasn't agreed to be there;
Accept that any damage to your phone or anything else is your responsibility, not ours.

2. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country) to use DAEM. If you are under the age of majority, you must have permission from a parent or guardian.

3. Your account

Some features require an account created via Sign in with Apple, Google, or email. You are responsible for activity under your account and for keeping your sign-in secure. You agree that the information you provide is accurate. We may suspend or terminate accounts that violate these Terms, cheat, or abuse the service.

4. Fair play

Scores and leaderboards depend on real, honest throws. You agree not to manipulate, spoof, or automate motion data, exploit bugs, or otherwise falsify results. We use server-side verification and may remove scores, reset standings, or ban accounts we determine to be cheating.

5. Spins, purchases, and subscriptions

DAEM includes a virtual currency ("spins") and may offer in-app purchases and an optional subscription ("DAEM Pro"). All purchases are processed by Apple through the App Store.

Virtual items. Spins and other virtual items have no real-world monetary value, are licensed to you, not sold, and are non-transferable and non-refundable except as required by law or Apple's policies.
Consumable purchases. Purchased spins are consumable and are used up as you take throws.
Auto-renewable subscription. If you buy DAEM Pro, it is an auto-renewable subscription. Payment is charged to your Apple ID at confirmation of purchase. The subscription automatically renews for the same period at the then-current price unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period. The price and length of the subscription are shown in the App at the point of purchase.
Managing and cancelling. You can manage or cancel a subscription, and turn off auto-renew, in your Apple ID account settings after purchase. Deleting the App does not cancel a subscription.
Refunds. Purchases are handled by Apple; refund requests are subject to Apple's policies. We generally cannot issue refunds directly for App Store purchases.

6. License

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App for your own non-commercial entertainment, subject to these Terms and to Apple's Licensed Application End User License Agreement, which applies to apps distributed through the App Store. Where these Terms and Apple's standard EULA conflict, the terms more protective of you for that issue apply.

7. Intellectual property

The App, including its name, design, code, graphics, and the "DAEM" brand, is owned by us and protected by intellectual-property laws. You may not copy, modify, reverse-engineer, resell, or create derivative works from the App except as permitted by law.

8. User conduct

You agree not to use DAEM to harass others, choose offensive usernames or display names, upload unlawful content, interfere with the service, or violate any applicable law. We may remove content and names that violate these Terms.

9. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that scores are precise, that the App will be uninterrupted or error-free, or that it is suitable for any particular purpose.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DAEM AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY DAMAGE TO YOUR DEVICE OR PROPERTY, LOSS OF DATA, OR PERSONAL INJURY ARISING FROM YOUR USE OF THE APP — INCLUDING FROM THROWING YOUR PHONE. Our total liability for any claim relating to the App will not exceed the greater of the amount you paid us in the 12 months before the claim, or USD $25.

11. Indemnity

You agree to indemnify and hold DAEM harmless from claims, damages, and expenses arising out of your use of the App, your throws, your violation of these Terms, or your violation of any rights of another party.

12. Changes and termination

We may modify the App or these Terms at any time. If we make material changes to these Terms, we will update the date above and, where appropriate, notify you in the App. Continued use after changes means you accept them. We may suspend or end the service, or your access to it, at any time.

13. Governing law

These Terms are governed by the laws applicable where the DAEM operator is established, without regard to conflict-of-laws rules, and subject to any mandatory consumer protections of your country of residence.

14. Apple as third-party beneficiary

These Terms are between you and DAEM, not Apple. Apple is not responsible for the App or its content. To the extent permitted, Apple is a third-party beneficiary of these Terms and may enforce them against you. Apple has no obligation to provide maintenance or support for the App.
